TERMS AND CONDITIONS OF SALE
The Maison commits to you with clarity, rigour and good faith. These terms and conditions of sale govern every order placed on the maisonesmia.com site. We invite you to read them carefully: they set out your rights, our commitments, and the terms of our relationship.

Hereinafter referred to as "the Maison", "we", "our" or "us".
Article 2 - Purpose and scope
These terms and conditions of sale (the "T&Cs") apply to any order of products placed by any natural person acting for purposes outside their commercial or professional activity (the "customer" or "you") on the maisonesmia.com site.
Any order implies full and unreserved acceptance of these T&Cs. They prevail over any other document, save for our express written agreement otherwise. The Maison reserves the right to amend them at any time; the applicable T&Cs are those in force on the date of the order.
Article 3 - Products
The products offered for sale are described and presented with the greatest care. The photographs and descriptions are as faithful as possible, but cannot bind the Maison in respect of slight differences in shade or appearance, in particular linked to your screen settings or to the artisanal nature of our materials.
Our products are offered subject to available stock. In the event of unavailability after your order has been placed, we will inform you as soon as possible and proceed with a full refund of the sums paid.
Article 4 - Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery costs. Delivery costs are indicated separately before the order is confirmed.
The applicable price is the one displayed on the site at the time the order is confirmed. The Maison reserves the right to change its prices at any time, it being understood that products are invoiced on the basis of the rates in force at the time the order is registered.
Article 5 - Order
The ordering process comprises the following steps: selection of the product, review of the basket, entry of delivery and billing information, choice of delivery method, confirmation and payment.
The sale is only definitively concluded after the Maison confirms the order, sent by email, and the full price is collected. Before confirming, you have the opportunity to review the details of your order and correct any errors.
The Maison reserves the right to refuse or cancel any order for legitimate reason, in particular in the event of a prior dispute, an abnormal order, or suspicion of fraud.
Article 6 - Payment
Payment is made online, at the time of the order, by the means offered on the site (bank cards and other payment solutions available at the time of the order). Transactions are secured via our payment provider.
The charge is taken at the time the order is confirmed. The Maison retains ownership of the products until the price has been paid in full.
Article 7 - Delivery
We deliver to Belgium, France, the Netherlands, Spain and Germany.
Standard delivery costs are:
€6 in Belgium;
€8 in France, the Netherlands, Spain and Germany.
An express delivery option within Belgium is offered at a rate of €12.
Delivery times are given for guidance only. The Maison cannot be held liable for delays attributable to the carrier or to an event of force majeure. In the event of a significant delay, you may contact us at contact@maisonesmia.com to agree on a solution.
The risks linked to transport are transferred to the customer at the moment when the customer, or a third party designated by them (other than the carrier), takes physical possession of the products.
Article 8 - Right of withdrawal
In accordance with Articles VI.47 et seq. of the Belgian Code of Economic Law, you have a period of 14 calendar days to exercise your right of withdrawal, without having to give a reason or pay a penalty. This period runs from the day on which you, or a third party designated by you (other than the carrier), take physical possession of the product.
To exercise this right, you may use the online withdrawal feature available at any time, without creating an account, on our "The Withdrawal" page (link available in the footer of the site), send us a clear statement by email to contact@maisonesmia.com, or use the model withdrawal form made available to you.
As soon as your request is received, we send you, without delay, an acknowledgement on a durable medium. The return and refund terms are detailed in our Return and Refund Policy.
Article 9 - Returns and refund
The conditions for returning products, the time limits, the required condition and the refund terms are governed by our Return and Refund Policy, which forms an integral part of these T&Cs.
The refund is made to the means of payment used for the order, within the time limits set out in that policy.
Article 10 - Legal guarantee of conformity
Independently of the right of withdrawal, you benefit from the legal guarantee of conformity provided for in Articles 1649bis to 1649octies of the Belgian Civil Code, applicable for 2 years from delivery of the product.
In the event of a lack of conformity existing at the time of delivery, the Maison will proceed, according to what is most appropriate, with the repair, replacement or refund of the product, at no cost to you. For any request, contact us at contact@maisonesmia.com, describing the problem and attaching photographs of the product concerned.
Article 11 - Liability
The Maison undertakes to take the greatest care in performing its obligations. Its liability cannot be engaged for damage resulting from misuse of the products, from the act of a third party, or from an event of force majeure.
No provision of these T&Cs has the effect of limiting or excluding the liability of the Maison in cases where such a limitation would be prohibited by law, in particular as regards the legal guarantee and consumer protection.
Article 12 - Intellectual property
All elements of the site (texts, visuals, logos, trademarks, product designations, layout) are the exclusive property of the Maison or its partners, and are protected by Belgian and international intellectual property law. Any reproduction, representation or exploitation, in whole or in part, without prior written authorisation, is prohibited.
Article 13 - Personal data
The personal data collected in connection with your order are processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy, available on the site. You have a right of access, rectification, erasure and objection, which you may exercise at contact@maisonesmia.com.
Article 14 - Force majeure
The Maison cannot be held liable for the non-performance of its obligations in the event of an event of force majeure beyond its reasonable control, as defined by Belgian law and case law.
Article 15 - Complaints and dispute resolution
For any complaint, we invite you to contact us first at contact@maisonesmia.com. We undertake to seek an amicable solution as soon as possible.
Failing an amicable resolution, you may have free recourse to the Consumer Mediation Service (Boulevard du Roi Albert II 8, 1000 Brussels; mediationconsommateur.be), competent in Belgium for consumer disputes.
If you reside in another Member State of the European Union, you may also contact the European Consumer Centre of your country of residence for cross-border disputes.
Article 16 - Applicable law and jurisdiction
These T&Cs are governed by Belgian law. In the event of a dispute, and failing an amicable resolution, the courts of the judicial district of Brussels shall have sole jurisdiction, subject to the mandatory consumer-protection rules allowing the consumer to bring proceedings before the court of their place of residence.
Article 17 - Amendment of the T&Cs
The Maison reserves the right to amend these T&Cs at any time. The applicable T&Cs are those in force on the day of the order. The most recent version is available at any time on the site.
Article 18 - Severability and entire agreement
If any provision of these T&Cs is held to be void or unenforceable, the other provisions shall retain their full validity. These T&Cs, together with the policies to which they refer, constitute the entire agreement between you and the Maison.
